§ 5302 Definitions - Different Types of Child Custody in PA

§ 5302. Definitions.

"Legal custody." The legal right to make major decisions affecting the best interest of a minor child, including, but not limited to, medical, religious and educational decisions.

"Partial custody." The right to take possession of a child away from the custodial parent for a certain period of time.

"Joint Custody" Is actually broken down into three categories. Joint Legal custody is where the parents share care and control of the upbringing of the child, but the child has only one primary residence.

"Physical custody." The actual physical possession and control of a child.

"Shared custody." An order awarding shared legal or shared physical custody, or both, of a child in such a way as to assure the child of frequent and continuing contact with and physical access to both parents.

"Shared Physical Custody" The child has two residences, spending at least 35% of their time with the other parent.

"Visitation." The right to visit a child. The term does not include the right to remove a child from the custodial parent's control.* You can make your own special joint custody agreement that is any combination of Shared Physical and Joint Legal Custody.
